Effective Date: January 1, 2025
Last Updated: January 1, 2025
Welcome to The House of Oria. By booking or receiving services with our makeup artists, you agree to the following Terms and Conditions, which are intended to ensure clarity, protection, and safety for all parties involved.
1. Acknowledgment and Acceptance of Risks
1.1 Clients acknowledge that makeup products and tools used during appointments may contain substances that could cause allergic reactions, skin irritation, or other sensitivities, even if they have no prior known allergies.
1.2 By booking an appointment with The House of Oria, the client assumes full responsibility for informing the makeup artist of any known allergies, sensitivities, or conditions that may affect the application of makeup.
2. Client Responsibilities
2.1 Disclosure of Allergies and Sensitivities: Clients must disclose any skin conditions, medical conditions, or allergies to the makeup artist prior to the start of the session. Failure to disclose this information releases The House of Oria and the makeup artist from liability related to any resulting reactions or injuries.
2.2 Patch Testing: Upon request, a patch test can be conducted during the scheduled appointment. If the client declines the patch test, they acknowledge the risks associated with using new or unknown products.
3. Liability Waiver
3.1 The House of Oria and its contracted or employed makeup artists shall not be held responsible for any adverse reactions, breakouts, skin conditions, or medical complications arising from:
• Failure to disclose relevant medical or skin conditions.
• Pre-existing skin conditions, allergies, or reactions to any products used.
• The application of products despite warnings or known risks.
3.2 The client agrees to waive any legal claims against The House of Oria, its employees, and its contracted makeup artists for injuries, skin conditions, or damages arising from makeup applications.
3.3 The House of Oria shall not be liable for any incidents caused by the misuse of products or failure to follow aftercare instructions provided by the artist.
4. Indemnification
The client agrees to indemnify and hold harmless The House of Oria, its owners, employees, and makeup artists from any claims, damages, or expenses (including reasonable attorney fees) that may arise out of their failure to disclose relevant information, misuse of products, or any legal disputes resulting from the services provided.
5. Service Cancellations and Refunds
5.1 Cancellations: Clients must notify The House of Oria of any cancellations at least 6 hours prior to the scheduled appointment. Failure to do so will result in a non refund of payment.
5.2 Refunds: Services provided are non-refundable. If a client experiences an allergic reaction, The House of Oria will assess any potential refunds on a case-by-case basis but is under no obligation to provide compensation.
6. Use of Products
6.1 All products used by The House of Oria’s artists are selected for their professional quality and suitability for a variety of skin types. However, clients understand that individual reactions may occur.
6.2 If a client prefers to use their own products, they must notify the makeup artist in advance. The House of Oria will not be liable for adverse reactions to any personal products supplied by the client.
7. Photo and Video Release
Clients may be asked for permission to photograph or film the final makeup look for promotional purposes. By agreeing, the client allows The House of Oria to use the images for marketing and social media without compensation.
8. Medical Emergencies
8.1 In the event of a medical emergency during a service, the makeup artist will follow basic first aid procedures and seek professional medical assistance if necessary.
8.2 The House of Oria is not responsible for any medical expenses incurred due to adverse reactions or emergencies during the appointment.
9. Force Majeure
The House of Oria shall not be liable for delays or cancellations due to circumstances beyond its reasonable control, including but not limited to acts of nature, natural disasters, or emergencies.
10. Governing Law
These terms and conditions shall be governed by the laws of the State of Connecticut, and any disputes shall be resolved through mediation or arbitration before escalating to court proceedings.
11. Agreement to Terms
By booking and attending an appointment, the client acknowledges that they have read, understood, and agreed to be bound by these terms and conditions.
